Abstract:
In today's law of guarantee for material defects, two totally different kinds of claims are united. On the one hand, there are claims which concern "increase-"interest of the buyer, and on the other hand, claims which refer to his interest of integrity. The author will discuss the last ones, especially the claims for compensation due to follow-up defects according to special rules. The claims are subjected in particular not to short limitation of actions of § 438 BGB, but to rule limitation of actions of § 195 BGB.
