Abweichendes Verhalten in staatlichen Behörden : Struktur, Bedingungen und Formen

Abstract

Der folgende Beitrag beschäftigt sich mit zwei Fragestellungen: erstens wird versucht, die Definition des abweichenden Verhaltens der Mächtigen auszudehnen auf zwar legale, aber „skandalöse“ Handlungen; zweitens werden einige strukturelle Bedingungen in der staatlichen Verwaltung untersucht, die abweichendes Verhalten von Bediensteten des öffentlichen Dienstes begünstigen. Konkret wird die „Filzokratie“ - die Verflechtung von staatlicher Verwaltung, politischen Parteien und kommunalen Wirtschaftsorganisationen - analysiert.

Contrary to the „Sociology of Nuts, Sluts and Perverts“ the sociological research in the „criminality of the powerful“ is restricted to the research in the illegal acts of powerful persons in business and govemment. We define and examine those deviant acts and decisions of civil servants in public bureaucracies which are not illegal in themselves, but do harm to the „clients“ of the public institutions and/or turn to an advantage for the officials. In particular we examine the structural conditions which favour these deviant acts and decisions of officials. Such a condition is the fact that political parties, public bureaucracies and local business organizaticns are entertwined (e. g. officials are appointed on party grounds); in every-day-language this phenomenon is named „Filzokratie“. Thus the bureaucratic mechanisms protecting the official against the influence of extern powerful groups do not operate anymore. Consequently, arbitrary deviations from principles and procedures of bureaucratic decision-making are favoured to the benefit of officials and/or extern pressure groups.
