Totale Institutionen und Rechtsschutz : einleitende Bemerkungen

Abstract

Zu dem in der Überschrift genannten Thema hat im Mai 1992 eine AJKTagung in Bremen stattgefunden. Ein erster Teil der Tagung war als Bestandteil zu den in Deutschland vorhandenen Erfahrungen mit gerichtlichem Rechtsschutz gedacht. In einem zweiten Teil der Tagung wurde über verschiedene andere Formen der Kontrolle totaler Institutionen im Ausland berichtet. Im abschließenden Teil der Tagung wurde versucht, rechtspolitische Folgerungen aus den verschiedenen Befunden zu ziehen.

Inmates rights were not dealt with in Goffman's famous essay on total institutions. This raises the questions whether prison ( and prison-like) institutions have become less total with the introduction of prisoners' rights and their access to courts of law. This was the central question of a conference in Bremen. Four of the contributions to his conference as weil as a conference report are reprinted in this issue. They come to ratherpessimistic conclusions as to the ability of courts to break up the total character of the prison institution.
