"Geständniszwang" : Überlegungen zu einer Theorie des Geständnisses

Abstract

Eine psychoanalytische Theorie wie diejenige Theodor Reiks, die tendenziell psychische Instanzen mit staatlichen Institutionen kurzschließt, kommt folgerichtig zu einem Begriff des Geständniszwanges. Geständnisarbeit und Strafbedürfnis des Subjekts entsprechen genau der von den staatlichen Institutionen ausgeübten Geständnisarbeit und ihrem Strafbedürfnis. Eine solche Theorie, die das Subjekt ausschließlich in seiner Zuwendung zur Staatsautorität betrachtet, hat ihre Wurzeln im lnquisitionsverfahren. In ihrer Kurzschlüssigkeit ist sie zwar auf einen singulären Fall zugeschnitten ( ihr Paradigma ist die Figur des Raskolnikow in Dostojewskis Verbrechen und Strafen), sie zeigt jedoch auch, daß jede Psychologie des Geständnisses das Inquisitionsverfahren beerbt, da sie nicht ohne eine Art Wahrheitstrieb auskommt, wenn sie das Geständnis als einen Akt des Subjekts denken will.

The psychoanalytical theory of Theodor Reik allows a short circuit between psychical agencies and institutions of the state, and therefore leads consistently to a concept of compulsion to confess. The subjects labour of confession and its need for punishment correspond exactly to the labour of confession and the need for punishment performed by public institutions. A theory like this, in which the subject is observed only as far as it is in relationship with the authority of the state, has its roots in the procedures of the inquisition. Itfits singular cases and not ordinary criminals (the paradigm is Rodion Raskolnikow in Dostojewskis novel Crime and Punishment); but it shows also, that every psychology of confession remains standing in the succession of the procedures of inquisition: it supposes a kind of truth instinct, if the confession is understood as an act of the subject.
